1. Definitions

In these Terms:

  • "Company," "we," "our," or "us" means Dopamine Global.
  • "Service" means Dopamine.so and related websites, applications, features, and support.
  • "User," "you," or "your" means any person who accesses or uses the Service.
  • "User Content" means prompts, text, images, files, and other content submitted to the Service.
  • "Subscription" means a paid recurring plan purchased through our payment provider.
  • "Third-Party Services" means services, tools, and providers not owned by us, including payments, analytics, hosting, and AI model providers.

2. Eligibility and Account Registration

  1. You must be at least 18 years old to use the Service.
  2. You must provide accurate and complete information when creating an account and keep it current.
  3. You are responsible for all activities under your account and for maintaining the confidentiality of your credentials.
  4. You must promptly notify us at [email protected] if you suspect unauthorized account access.

3. Subscriptions, Billing, Renewals, and Taxes

  1. Dopamine.so is offered on a recurring monthly subscription basis, and additional plan options may be offered from time to time.
  2. Current plan names, included usage allowances, and advertised pricing are shown on our pricing pages and in-product billing flows.
  3. Payments are processed by Creem. By purchasing, you also agree to Creem's terms and policies.
  4. Subscriptions automatically renew unless canceled before the next renewal date.
  5. You authorize recurring charges for subscription fees, applicable taxes, and any permitted charges tied to your use.
  6. Included usage allowances (such as monthly credits and concurrency limits) apply per billing cycle and may reset at renewal. Unless expressly stated otherwise, unused monthly allowances do not roll over.
  7. If top-ups, add-ons, or overage purchases are offered, they are billed separately and subject to these Terms.
  8. We may update plan pricing, features, limits, or included allowances from time to time. Any changes will apply at a future billing date unless stated otherwise.
  9. You are responsible for any taxes, duties, or government charges associated with your purchase, except taxes based on our net income.
  10. If payment fails or is overdue, we may suspend access to paid features until payment is resolved.

4. Cancellation and Refunds

  1. You may cancel at any time through your account billing settings.
  2. Cancellation takes effect at the end of your current paid billing period. You retain access through that period unless suspended under these Terms.
  3. All purchases are final. Dopamine.so has a strict no-refund policy for subscriptions, top-ups, add-ons, partial billing periods, and unused usage allowances, except where required by applicable law.

5. Acceptable Use and Prohibited Activities

You may not use the Service to:

  • Violate any law, regulation, or third-party rights.
  • Create, request, upload, or distribute obscene content, sexually oriented services, or mature-audience adult digital content, including downloadable adult images or videos, webcam/live adult content, or adult subscription access.
  • Upload, generate, or distribute malware, harmful code, or phishing content.
  • Hack, probe, disrupt, or attempt unauthorized access to systems or data.
  • Spam, harass, abuse, or engage in deceptive or fraudulent behavior.
  • Infringe copyright, trademark, patent, privacy, publicity, or other IP rights, including generating unauthorized celebrity likenesses, impersonations, or branded character content.
  • Generate or distribute content that promotes hate, violence, or discriminatory intolerance, including hate symbols or targeted harassment.
  • Submit policy-violating content, including content involving exploitation, abuse, or other unlawful material.
  • Circumvent technical controls, safety controls, usage limits, or anti-fraud systems.

We maintain these restrictions in part to comply with payment-provider and partner requirements. Content that triggers payment-network risk rules (including explicit adult digital content) may be blocked or removed, and related accounts may be suspended.

You may not use the Service or any public examples, galleries, or marketing materials to promote infringing use cases, including "generate Disney/Marvel/celebrity images" style positioning.

We may apply automated scanning and report-based review to enforce these rules. We may remove content or restrict access when reasonably necessary for safety, legal compliance, or platform integrity.

6. Usage Limits, Fair Use, and Anti-Fraud

  1. We may apply usage limits, rate limits, concurrency limits, and fair-use controls to maintain reliability and prevent abuse.
  2. We may suspend or restrict accounts involved in chargeback abuse, payment fraud, automated extraction at abnormal volume, or other misuse.
  3. Any usage allowances included in a plan are personal to your account and may not be transferred, resold, or brokered.

7. User Content and License to Operate the Service

  1. You retain ownership of your User Content.
  2. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, and transmit User Content solely as needed to operate, secure, and improve the Service for you.
  3. You represent that you have all rights needed to submit User Content and to grant the above license.

8. AI and Model Training

  1. We do not use your User Content to train our own AI models.
  2. We use third-party AI providers to deliver parts of the Service.
  3. Your use of AI features remains subject to these Terms, our safety controls, and applicable third-party provider terms where required.

9. Intellectual Property and Feedback

  1. The Service, including software, design, branding, and related materials, is owned by Dopamine Global and its licensors and is protected by intellectual property laws.
  2. Except for rights expressly granted in these Terms, no rights are transferred to you.
  3. If you provide feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.

10. Copyright Complaints (DMCA/Notice-and-Takedown)

If you believe content on the Service infringes your copyright, send a notice with:

  • Your contact information.
  • A description of the copyrighted work.
  • A description of the allegedly infringing material and its location.
  • A statement of good-faith belief and a statement under penalty of perjury.
  • Your physical or electronic signature.

Notices can be sent to [email protected]. We may remove or disable access to allegedly infringing content where appropriate.

11. Third-Party Services

The Service depends on Third-Party Services (for example, payment processing, hosting, analytics, and AI providers). We are not responsible for third-party services, and your use of those services may be subject to their terms and privacy policies.

12. Term and Termination

  1. These Terms apply while you use the Service.
  2. You may stop using the Service at any time.
  3. We may suspend or terminate your access immediately if you materially violate these Terms, create legal risk, or threaten the security or availability of the Service.
  4. On termination, provisions that by their nature should survive will survive, including payment obligations, IP provisions, disclaimers, liability limits, and dispute terms.

13. Service Availability and Changes

We provide the Service on a best-effort basis and do not offer a specific uptime service level in these Terms. We may modify features, limits, or functionality at any time. Features labeled beta, preview, or experimental may be unavailable, unstable, or changed without notice.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOPAMINE GLOBAL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Dopamine Global and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of applicable law or third-party rights.

17. Governing Law and Dispute Resolution

  1. Informal resolution: Before filing a formal claim, both parties agree to attempt to resolve disputes by contacting [email protected].
  2. Arbitration: Any dispute not resolved informally will be finally resolved by binding, individual arbitration, except where prohibited by law.
  3. Class action waiver: To the extent permitted by law, disputes must be brought on an individual basis, not as a plaintiff or class member in any class or representative action.
  4. Exceptions: Either party may seek injunctive or equitable relief for intellectual property misuse or unauthorized access.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the Last Updated date. Changes become effective when posted unless otherwise stated. Your continued use of the Service after the effective date of updated Terms means you accept the updated Terms.
